On January 13, 2021, the Supreme Court of Justice of the Nation resolved 3 complaints in connection with the controversies between the local congress and the Government of the State of Baja California Sur; such complaints had as subject matter the compliance (or non-compliance) of the suspensions granted by our highest court while it decides the merits of the controversy between the executive and the congress of Baja California Sur. The Supreme Court resolved, with respect to the alleged non-compliance of the State Government, that such allegations are unfounded and consequently that there was no violation, excess or defect in the compliance with such suspension.

Subsequently, the Supreme Court granted reason to the State Government and resolved that there was a defect in the compliance by the local congress, and therefore ordered to carry out all the necessary actions and conducts to give exact compliance to the measures granted in favor of the State Government to safeguard the institutional and constitutional order of the State of Baja California Sur. This victory of the executive will surely serve as a precedent for future cases in which a local congress may want to exceed its powers.
